Terms of Service

1. Eligibility and Accounts

• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account and credentials.
• You agree that the information you provide is accurate and kept up to date.

2. Use of the Service

• The Service provides AI-assisted plant health insights and suggested care plans.
• The Service is for informational purposes only and is not a substitute for professional horticultural or veterinary advice.
• You are responsible for your use of the Service and any actions you take based on results.

3. User Content

• You may submit photos, plant details, and other materials ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, process, and display it solely to operate and improve the Service.
• You represent that you have the rights necessary to submit the User Content and that it does not violate applicable law or third-party rights.

4. Prohibited Conduct

You agree not to:

• Use the Service for unlawful purposes or in violation of any applicable laws or regulations.
• Reverse engineer, decompile, or attempt to derive the source code of any part of the Service.
• Interfere with or disrupt the Service or bypass any access or security measures.
• Upload harmful code, spam, or content that is illegal, infringing, or abusive.

5. Intellectual Property

The Service, including software, interfaces, and content (excluding your User Content), is owned by AI Plant Doctor or its licensors and is protected by intellectual property laws.

You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6. Credits and Subscriptions

Certain features of the Service require credits or a paid subscription. This Section explains how credits, free trials, and our Premium Subscription work, and how we handle billing, renewals, and cancellations.

• Credit Packs: You may purchase credit bundles in-app. One credit equals one diagnosis. Credits never expire, remain linked to your account, and are non-transferable.
• Free Monthly Credits: Registered users receive up to three promotional credits each calendar month. Promotional credits expire at the end of the month if unused and are not redeemable for cash.
• Premium Subscription: Premium is billed at $7.99 per month (or the amount shown at checkout) and automatically deposits 20 credits into your account on each billing date. Unused subscription credits roll over while you remain subscribed.
• Auto-Renewal Consent: When you start Premium or a free trial, you authorize us (or the applicable app store) to charge the subscription fee to your chosen payment method each billing period until you cancel. We provide a confirmation email or in-app receipt that includes key offer terms and cancellation instructions.
• Promotions and Free Trials: If Premium includes a free or discounted introductory period, charges begin at the posted rate when the trial ends unless you cancel at least 24 hours before renewal. We will send advance notice of material changes to price or benefits.
• Cancellation: You can cancel Premium at any time. Purchases made through Apple App Store or Google Play must be canceled through the respective platform's subscription settings; web purchases can be canceled from your account dashboard or by emailing support@theaiplantdoctor.com. Cancellation takes effect at the end of the current billing cycle.
• Refunds and Guarantees: We offer a 7-day satisfaction guarantee on the most recent Premium billing cycle and on credit packs. Contact support@theaiplantdoctor.com within 7 days of purchase to request a credit refund. Beyond that window, fees are non-refundable except where required by law.
• Billing Issues, Taxes, and Processors: We may use third-party payment processors. You agree to pay applicable taxes and fees. Price changes will be communicated in advance, and continuing to use paid features after the effective date constitutes acceptance.

7. Privacy

Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you consent to our data practices described there.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AI PLANT DOCTOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI PLANT DOCTOR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold AI Plant Doctor harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your User Content, your use of the Service, or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if necessary to protect the Service or other users. You may stop using the Service at any time. Certain provisions survive termination, including Sections 5–10.

12. Changes to the Service and Terms

We may modify or discontinue features at any time. We may update these Terms from time to time. Material changes will be posted here and, where appropriate, communicated in-app. Your continued use of the Service after changes indicates acceptance.

13. Governing Law

These Terms are governed by the laws of your place of residence unless a specific jurisdiction is required by law. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
